Article 1 – Definitions
The following definitions apply to these General Terms and Conditions:

Withdrawal Period: The time frame in which the customer may exercise their right to cancel the purchase.

Consumer: A natural person not acting in the course of a trade or profession who enters into a distance contract with Sofia’s Boutique Hamptons.

Continuous Contract: A distance agreement relating to a series of products and/or services over time.

Right of Withdrawal: The consumer’s right to cancel a distance contract within the stated withdrawal period.

Business: Sofia’s Boutique Hamptons – offering products to consumers via distance sales.

Distance Contract: A contract concluded between the consumer and Sofia’s Boutique Hamptons using online communication methods.

CESOP: The EU's Central Electronic System of Payment Information used to monitor payment service providers.

Article 3 – Scope of Application
These terms apply to all offers and agreements between the consumer and Sofia’s Boutique Hamptons. Prior to concluding any agreement, these terms will be made electronically available to the consumer.
Article 4 – Offers
All offers on the website are non-binding. Sofia’s Boutique Hamptons reserves the right to update or change prices and availability at any time. Prices listed include product price and, where indicated, shipping. Import duties, taxes, customs clearance fees and any courier surcharges are the customer’s responsibility, unless explicitly stated otherwise.
Article 5 – Agreement
Once an order has been placed and payment has been confirmed, the agreement becomes binding. From this moment onward, orders cannot be cancelled under any circumstances. This confirmation marks the start of a binding agreement between both parties.

Customers must wait until the package has been delivered before any return request can be submitted, in accordance with Article 6 and 6a.
For clarity, cancellations are not possible after payment confirmation. See the ‘Order Cancellations’ section in our Return Policy.
Article 6 – Right of Withdrawal
Consumers have the right to withdraw from their order within 14 days of receiving the product. No reason is required for cancellation. Return shipping costs are the consumer’s responsibility.
Article 6a (Exclusions from Right of Withdrawal)
Items discounted by 40% or more are final sale and cannot be returned, refunded, or exchanged. Sale items with a discount of less than 40% may be returned in accordance with our Return Policy.
Article 7 – Costs in Case of Withdrawal
Upon withdrawal, Sofia’s Boutique Hamptons will refund the consumer within 14 days after receiving the returned item, provided it is in its original condition and packaging.
For all eligible returns, a $15 restocking fee per item applies to cover inspection and handling costs.
Article 8 – Customs and VAT
The consumer is responsible for any applicable customs fees, import duties, taxes, and compliance with local regulations. Sofia’s Boutique Hamptons is not the official importer of record for international orders.
Any costs incurred during customs processing, including additional charges by couriers, are the sole responsibility of the customer.
We provide appropriate shipping documents, but cannot guarantee customs clearance or local compliance. Please check your country’s import policies before ordering.
Article 9 – Compliance with CESOP
In accordance with EU law, payment service providers may report transaction data to the CESOP system. Sofia’s Boutique Hamptons complies with these legal obligations where applicable.
Article 10 – Compliance and Warranty
All items sold are expected to meet the descriptions and standards presented. If the product arrives defective or not as expected, the customer must notify us in writing within 14 days of delivery. Returns must be in original packaging and condition.
Article 11 – Delivery
Orders are normally delivered within 30 days. If a delay occurs, the customer will be informed within 14 days after placing the order.
The customer is legally responsible for handling import and customs formalities. Sofia’s Boutique Hamptons is not liable for customs delays or related costs. Failure to comply with customs obligations is not grounds for cancellation or refund.
Article 12 – Complaint Resolution
Complaints must be submitted via email within 7 days of discovering the issue. We aim to respond within 14 days. If more time is required, we will notify the customer with a new estimated resolution time.
Article 13 – Disputes
These terms are governed by the laws of the United States. Any disputes will first be resolved through dialogue. If unresolved, disputes will be handled by the competent court in New York, USA.
Nothing in these Terms limits your statutory rights under applicable consumer protection laws.
